2-. Liability of www.voyagemongolie.com

All clients understand clearly that the owner of the website www.voyagemongolie.com is an independent representant of the company M.A.T.B in Mongolia. www.voyagemongolie.com is not responsible of any problem that may occur during the trip in Mongolia. Www.voyagemongolie.com is responsible of the booking service and to give all the informations before the trip to Mongolia as well as assuring that your deposit is used to plan your trip to Mongolia. Any further request must be made to the travel agency in Mongolia.

3-. The Contract between M.A.T.B (www.voyagemongolie.com as a representant) and the clients

These conditions form the contract between M.A.T.B ("The Company") and the client named on the booking form. To secure a booking the Company requires a completed and signed booking form and the necessary deposit. Registration on one of our trips implies that the client agrees with our general conditions. Bookings are accepted on the understanding that the client appreciates the possible risks inherent in adventure travel.

4-. Cancellation of the travel with www.voyagemongolie.com by the client

In case of cancellation of your travel more than 40 days before departure the 90% of your deposit will be refunded by www.voyagemongolie.com
In case of cancellation 39-20 days before departure, 50% of the deposit will be refunded by www.voyagemongolie.com . In case of cancellation less than 20 days before departure the full amount deposit will be retained by www.voyagemongolie.com .

5-. Cancellation or date change by the company (for group tours)

Our dated group tours are subject to a minimum of four clients. Each tour will be reviewed one month before departure and if it is necessary for us to cancel on account of low numbers a full refund will be given. If the tour has to be canceled for any other reason beyond our control the Company will offer the client a full refund on money paid. The Company will not be liable for compensation beyond a full refund of money paid.

6-. Responsibilities of the client

Clients are responsible for ensuring the validity of their passport beyond the full duration of their travel. Also they are responsible for obtaining the necessary visas and vaccinations for Mongolia.

Clients must yield to the conditions and formalities of police, customs and health in the country at the time of travel. If the client does not respect the laws of the country, cannot show the correct documents, or is delayed because of his own fault, he is responsible for the incurred costs.

Each client must accept the authority of the tour leader. The tour leader will not be held responsible for incidents or accidents which may occur as a result of unwise personal initiative.

If the health or conduct of any client before or during the tour appears likely, in the opinion of the tour leader, to endanger the group, the client may be excluded from the tour. Expenses resulting will be borne by the client and a refund of money paid will not be given.

7-. Travel Insurance

It is obligatory to have full travel insurance covering cancellation, illness, loss of luggage and repatriation. A copy of each client's insurance is required by the Company prior to departure. Clients must ensure that there are no exclusion clauses limiting protection for the type of activities included in their tour (e.g. horse riding, boating). The Company will not accept any responsibility for luggage and personal property of the client.

8-. Illness and Disability

Anyone suffering from any illness or disability, or undergoing treatment for any physical or medical condition, must declare the nature of the condition at the time of booking. Such a client must make his own arrangements for drugs and treatment required during the tour. If the Company is not so informed this constitutes a breach of contract and may result in the client being excluded from the tour. In this case money paid will not be refunded to the client.

9. Alterations to the itinerary

A travel in mongolian countryside implies that you will spend nights in tents at campsites or in ger camps. Food is prepared on a gas stove or open fire (wood or dung). Whenever possible, we choose for campsites places located near a river or a lake where you have plenty of water for cleaning food and for your personal sanitary purposes.

Altitude is frequently equal to or higher than 2,000 m above sea level. You are often several days of road away from the first doctor.

Risks associated with this kind of travel involving challenges and adventures can never be excluded. However, such risks are overall very low in Mongolia during the warm season. Your safety and comfort are the first concerns of our guides, nevertheless, we can not provide a 100% guarantee of a voyage without any hazard or risk for you.

We will discuss with you your motivations and capacities

Prior to travelling with us, you should acknowledge that you are have been informed of and are aware of the risks and constraints related such a voyage of adventure. If necessary or advisable to do so, the Company reserves the right at any time to alter arrangements for any aspect of the tour. Clients will be informed of any changes prior to departure, and if the change involves a significant change in the itinerary then the client may cancel the booking within seven days of notification and receive a full refund of money paid.

If any unexpected events or circumstances which imply the security of the clients should occur (e.g. broken bridges, defected roads, epidemic, etc.) we retain the right to alter the dates, timetable or route as we see fit. The client cannot claim any compensation in these circumstances.

The payment of the deposit means your agreement concerning the plan trip. M.A.T.B is not responsible if you would like to make change that M.A.T.B would judge impossible to make after your arrival. M.A.T.B. keeps the possibility to change the plan for security reason or any reason out of our control (overbooking from the hotel or ger camps along the itinerary, heavy rain, impracticable roads, unreachable destination at the time of planning the trip, natural disaster, closed area, politic problems, etc…). The Company will not be held responsible for providing refunds if a situation arises during the tour which necessitates a change in the itinerary (including threat of war, riots, civil action, strikes, political or legal restrictions, force majeur, technical problems, decisions of air carriers, or other situations beyond our control) unless it can be proved that the situation has arisen out of negligence on the Company's behalf.

If for any reason beyond the control of the Company your return to Ulaanbaatar is delayed causing missed international departure, costs incurred must be borne by the client. The company will endeavor to give all practical assistance in obtaining necessary documents of proof if required by the insurance company for repayment of costs incurred.

10. Registration steps

1 - you contact us to let us know of your wishes and expectations for your trip project (dates, number/profile of the participants, activities, services, routes, fields of interests)

2 - we discuss with you the itinerary, including the duration and the route, and send you a detailed service offer

3 - we can modify this offer according to your comments or new requests

4 - you confirm your agreement on the final offer

5 - you transfer by wire or by Paypal to our bank account of our representant in Canada 40% of the sum agreed to make a firm reservation

6 - we send you a receipt which includes a confirmation of your reservation, terms of the offer and a certificate for obtaining your visa

11-. The payment of the deposit

The payment of the deposit mean your total agreement to the conditions and terms of travel.

40% of the total amount of the deposit has to be made to www.voyagemongolie.com troughout Paypal (Paypal account Mongoliealacarte@hotmail.com or to the bank account to his partner directly in Mongolia. The balance must be paid on arrival.

M.A.T.B and www.voyagemongolie.com notice that services provided in connection with its itineraries, including transportation, hotel accommodations, restaurants, ger camps and other services, are purchased from various independent suppliers who are not affiliated with our travel agency partner in Mongolia, in any way. Although it endeavors to choose the best suppliers available, M.A.T.B has no right to control their operations and therefore makes these travel arrangements upon the express condition that M.A.T.B , and its own agents and employees, shall not be liable for any delay, mishap, inconvenience, expense, irregularity, bodily injury or death to person, or damage to property occasioned through the conduct or default of any company or individual engaged in providing these services. Each of these passenger conveyance companies, tour companies, hotels, restaurants, etc., is subject to the laws of the state or country where the service is provided.

M.A.T.B or www.voyagemongolie.com shall not be liable for: (a) expenses such as additional hotel nights and meals not specified in the trip itineraries that may be required either en route, prior to, or following a trip, when caused by individual clients' travel arrangements, by airline scheduling or airline schedule changes, canceled flights, missed flight connections, or by other factors not under M.A.T.B control; (b) expenses incurred in recovering luggage lost by airlines, belongings left behind on a trip, or in shipping purchases or other goods home from abroad; (c) bodily injury or property damage for any reason, including but not limited to acts of God, weather, quarantines, strikes, civil disturbance, theft, default, detention, annoyance, changes in government regulations, terrorism, war, or failure of conveyance to arrive or depart as scheduled, etc., over which it (M.A.T.B) has no control.

M.A.T.B reserves the right to take photographic or film records of any of our travels in Mongolia, and may use any such records for promotional and/or commercial purposes.
